Terms of Service

1. About These Terms

These Terms of Service ("Terms") govern your access to and use of the GetMyNIE platform (getmynie.com), operated by GetMyNIE Ltd, a company registered in Cyprus ("GetMyNIE", "we", "us"). By creating an account or purchasing a service, you agree to these Terms.

If you do not agree, please do not use our services.

2. Our Services

GetMyNIE offers two tiers of assistance for obtaining a Spanish NIE (Número de Identificación de Extranjero):

  • Guided Service (€49): We review your documents, guide you step-by-step through the application process, and prepare all forms. You attend the appointment in person.
  • Full Representation (€199): We act on your behalf via a notarised power of attorney. Our registered representative attends the appointment for you. You do not need to be present in Spain.

3. No Guarantee of Outcome

GetMyNIE provides an administrative assistance service. The decision to grant or deny a NIE rests solely with the relevant Spanish authority (Policía Nacional or Consulado). We do not guarantee approval of any application.

We will exercise reasonable skill and care in preparing and submitting your application. We are not liable for delays or refusals caused by Spanish authorities, changes in immigration law, or information you provide that is inaccurate or incomplete.

4. Your Obligations

You agree to:

  • Provide accurate, complete, and up-to-date information and documents.
  • Notify us promptly if any information changes after submission.
  • Not use the platform for any unlawful purpose or to submit fraudulent documents.
  • Maintain the confidentiality of your account credentials.

5. Payment and Invoicing

Payment is required in full before your application is processed. Prices are displayed inclusive of applicable VAT. VAT is calculated based on your billing country in accordance with EU VAT regulations.

Payments are processed securely by Stripe. A VAT invoice is generated and available for download from your account once payment is confirmed.

6. Refund Policy

You have a right of withdrawal under EU consumer law (Directive 2011/83/EU) within 14 days of purchase, provided we have not yet begun processing your application.

Once document review has commenced, the right of withdrawal is waived (as permitted under Art. 16(a) of the Directive, which you expressly acknowledge by proceeding with your application). In such cases, no refund will be issued unless we have failed to deliver the agreed service.

If we are unable to complete the service due to circumstances on our side, you will receive a full refund. To request a refund, contact us at contact@getmynie.com.

7. Intellectual Property

All content on the GetMyNIE platform — including text, graphics, logos, and software — is the property of GetMyNIE Ltd or its licensors and is protected by applicable intellectual property laws. You may not reproduce or distribute any part of it without our prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, GetMyNIE's total liability for any claim arising out of or related to our services shall not exceed the amount you paid for the service giving rise to the claim.

We are not liable for indirect, incidental, or consequential damages, including loss of profit or opportunity, even if we have been advised of the possibility of such damages. Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded by law.

9. Termination

We may suspend or terminate your account if you breach these Terms, provide fraudulent information, or use the platform in a way that could cause harm to us or others. We will give you reasonable notice where possible.

You may close your account at any time by contacting us. Termination does not affect any rights or obligations that arose before termination.

10. Governing Law and Disputes

These Terms are governed by the laws of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus, except where mandatory consumer protection laws in your country of residence give you the right to bring proceedings before your local courts.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice on the platform at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the revised Terms.
